Topic MIOSHA Enforcement & Regulatory Update: Using All the Tools in the Toolkit
It’s time to look back and take stock of what we learned from and about MIOSHA and federal OSHA during these very eventful years since the COVID-19 pandemic, and look ahead at what MIOSHA’s and fed OSHA’s regulatory and enforcement priorities will be in the near term. That picture is becoming clearer (and more fraught for employers) as the worker safety agencies take more aggressive enforcement positions, and advanced the most active rulemaking agenda in recent history. Fed OSHA has led the way with a flurry of new and amended final safety standards, and the State OSH Plans, like MIOSHA, are expected to follow.
In this program from the Mid-Michigan ASSP Chapter, attorneys from Conn Maciel Carey’s national OSHA Practice, including Michigan-based MIOSHA specialists, will review these recent OSHA enforcement and rulemaking developments and discuss the top OSH issues that Michigan employers should monitor.

Speakers
Anthony M. Casaletta is a Senior Counsel with Conn Maciel Carey LLP, working in the Detroit area, where he provides the full range of workplace safety and health law services to employers in Michigan and around the country. Tony counsels and defends employers across a diverse range of industries in a wide variety of workplace health and safety matters involving Federal OSHA and State OSH Plans, particularly the Michigan Occupational Safety and Health Administration (“MIOSHA”). He supports clients in all aspects of enforcement actions involving OSHA agencies, from managing on-site inspections and investigations, to litigating contested OSHA citations, and counseling on compliance with OSHA enforcement rules and standards. Prior to entering private practice, Tony spent 18 years with Michigan OSHA in various roles, working his way up to Health Supervisor for the MIOSHA Construction Safety and Health Division.
Eric J. Conn is a Founding Partner and Chair of CMC’s national OSHA • Workplace Safety Group. Eric spent a decade of his 20+ year career practicing alongside the former first General Counsel of the OSH Review Commission. He represents employers in inspections, investigations and enforcement actions involving OSHA, the CSB, MSHA, EPA and state and local safety-related agencies. He handles all aspects of OSHA litigation and conducts and directs workplace safety audits, delivers safety training, and helps employers develop and implement compliant safety and health programs. He writes and speaks extensively on safety & health law issues, including curating the award-winning OSHA Defense Report blog and authoring chapters in OSHA Treatises. He is proud to have presided over CMC’s OSHA Practice when it was recognized as one of only three “Band 1” Rated OSHA Law Firms by Chambers USA in 2022 and every year since. Eric was also recognized as one of only nine Band 1 rated OSHA law practitioners nationwide.
Daniel C. Deacon is a Partner in the Washington, DC office of Conn Maciel Carey, working in the OSHA • Workplace Safety Practice Group. Dan represents and advises employers during inspections and investigations conducted by the federal Occupational Safety and Health Administration (OSHA) and state OSHA programs, responds to notices from OSHA about employee complaints of safety hazards, and represents employers in OSHA litigation, including citation contests and administrative hearings. He also helps employers develop safety and health programs and policies and conducts presentations on a variety of workplace safety topics.
Valerie Butera is a Senior Counsel with Conn Maciel Carey LLP’s OSHA Practice, working remotely in greater Detroit, MI. Valerie’s practice focuses on the representation of employers and trade associations in workplace safety and health matters. She has extensive experience, both in private practice and in-house, working with a wide range of industries. Valerie litigates cases for employers cited by OSHA and State OSH plans for alleged violations of numerous state and federal workplace safety regulations. She also provides comprehensive counsel for issues ranging from how best to navigate an OSHA inspection to the implementation of process safety management programs.
